Update: Hate to say I told you so but… I did. Elected Republicans are racing away from a fight as fast as they can
Today President Obama will announce his nomination of Solicitor General Elena Kagan to the Supreme Court of the United States. You can read a great summary of her life’s work at SCOTUSblog.
I have yet to see much against her other than she is a liberal. We knew Obama would nominate a liberal so that much is not a surprise. The issue we face now is that barring any major revelation or complete breakdown during the confirmation hearings to turn public opinion on her rapidly, we can pretty much expect her to waltz in.
Why do RINO’s matter? Why shouldn’t we just embrace them in the name of diversity? Nomination hearings for the Supreme Court are why. While I am sure committed conservatives will race to build arguments against her judicial philosophy, we have Senators like Lindsay Graham ready to tear down any opposition.
The last nominee might as well have entered the room with a T-shirt reading “I don’t love the Constitution.” There was Lindsay Graham pretending to bring on some sass, telling the room he had “doubts” about her. Then he would go on national TV each night and basically undermine his own arguments and speak ill of anyone who called her what she was, a socialist who ruled not with the Constitution, but with her own convictions at the center.
Frankly elected Republicans don’t have the numbers to mount much of a fight and if they did there are enough of them without conviction or confidence to march forward under fire. November 2010 matters because we are without strong leadership or committed representatives. When the vote matters, we don’t have the firepower.
While I am loathe to say it, I am pretty convinced liberals will now have a 50 year old defender of their beliefs in a powerful lifetime position. All without much of a fight. I hope I am wrong but watching the Sotomayor hearings and witnessing how ineffective our representatives were, I cannot expect much better this time around.
